I'm not sure how much Disney could do. I don't think they licensed the story from the Brothers Grimm estate. Technically, as long as people stay away from the looks of the animated film, they haven't violated Disney's property rights. The original fairy tale is public domain.

I'm sure they got a little contact...a little letter from Disney's lawyers.

The first thing I thought, was they adapted the design from Disney's film, including the look of the characters and furniture. While the story is probably in the public domain, the 'Disney look' is there's.

I've seen plenty of knock offs, they are always obvious they are not Disney toys. They use similar coloring, because the Disney look, is the look we all expect for characters. If you make Snow White with long black hair and green dress no one will recognize her.

In the case of this ad, it's a obvious copy of the characters, for commercial purposes, and done in a way they can claim it could damage the brand.

This is one of those times when I say, let those lawyers at 'em. It sounds like this could be a small company, and I doubt it would take more than a threat of legal action to get them to back off.

I'm with Robin on this one, I'm okay with parody and don't believe Disney owns everything. But in this case, they are infringing in my opinion. Just too many similarities.

There are certain children's stories and characters that I don't find funny being X-rated. Specially when it's out there for kids to see.

Cast members joking around are one thing, but businesses need to find their own ideas, rather than pervert kiddie stories. (I also despise foul mouth Elmo "jokes".)

As Moley says, Disney LOVES getting rich by using other peoples original work. Those old stories are all there just waiting for companies to grab and run with material that has entered the public domain due to age. Of course, Disney fights tooth and nail to keep Mickey from falling into that same category! ;)

Parody is allowed though... Wonder if this is a one picture parody or if they have an entire ad campaign using the same theme with multiple images?

I'm sure the Disney lawyers will be all over this no matter what. From what I have read Disney won't allow Snow White in Epcot to be pictured with anyone even holding a beer! (i.e. when she meets and greets in Germany - I'm sure this comes up often!) :yes:

I never thought of that in regards to Epcot, but I remember when I attended a private party in the MK, you could not hold an alcoholic beverage in a photo with the characters.

Now that I think of it, I don't think I've ever seen any kind of drink in a photo unless someone was wearing a water bottle. Since you can't tell what is in a cup, it would be interesting to note if a person can hold any identifiable (and spillable!) drink with characters.

If I were a costumer (and I am, BTW), I'd absolutely forbid any sort of food or drink (except clear water) anywhere near any costume that I'd slaved over. Stains, ya know....
