View Full Version : Using Photopass pictures in avatar/signature?

I purchased a Photopass picture that I just love and would like to use it as a new avatar. After scanning it, though, it dawned on me that maybe that's not kosher. I was thinking that it's considered copyrighted by Disney.

Anyone know if this is a real issue or if I'm just being weird?

Disney gave me the OK to make holiday cards from a "studio" shot I bought at Disneyland. I think you're safe to post your weird photo even if you don't keep Kosher. :D

I am not attorney but did work for 2 law firms that never dealt with Copyright laws. Helpful, yes?

Once you buy it, it is now owned by you. You may scan it and put it in an avatar.

Thanks for the help. :) I didn't have deep enough pockets to thwart a copyright infringement lawsuit. ;)

Even when you purchase a photo, the person/entity who took said picture still holds the copyright.

Amy, the photopass cd's have a copywrite release on them. If you would feel more comfortable having that release in hand, I can print you off a copy or email it to you.

Thanks, Linda. But I think that's specifically to show to a photo business if you are asking them to make copies of your pictures. :shrug:

I've sent my question through the Photopass "contact us" link to make sure I'm not doing anything wrong. But in the mean time, I'll enjoy my new avatar ...even if it's short-lived. :mrgreen:

You do realize that most of us don't 'own the copyright' to our avatars and tags, don't you. ;)

This is not a problem.

When you buy a PhotoPass pic - or any of the in-park pics like ride photos - you are granted a limited-use license to use the pic freely for personal purposes like prints, gifts, cards, avatars, etc. Disney still holds the copyright on these pics, so you are not allowed to use them for any commercial purposes, but for personal stuff, you're fine.

The release from the CD specifically says "Photo Image CD Sale Agreement" so it's probably not valid for the individually purchased photos, but I believe that the same terms and conditions apply for the individually purchased photos.

I don't think they will care either way considering you aren't trying to profit off of it. Just remember the important rule "It is easier to ask forgivness than permission!" :lol:

Yes, apparently it's even more difficult to "ask permission" than I thought it would be. My reply from PhotoPass told me they couldn't help me, that I would have to call the Disney legal department. :blink:

Ummm .... let me think about that. Uh, how about I just let their legal department to call me if they have a problem? :lol: Geez. :rolleyes:

What are we turning her into? Wouldn't she need a Wonder Twin? One Wonder Twin always turns into an animal and the other turns into a form of water. I suppose Amy turns into an animal as she's already dubbed herself "amymouse". But mice aren't very ferocious. Hopefully she has the power and know-how to turn into other animals both mythological and real. How about a fire-breathing cat? No one would ever suspect a little kitty could toast them. MEOW!
